Earlier in the day, Das andRanka approached the Delhi high court challenging the extension of their custody following a protest at Jantar Mantar. The court questioned why they had invoked its writ jurisdiction when an alternative legal remedy was available. “Your second incident. You are a person who has actually broken a bond. Your remedy actually lies in revision,” the court observed. It also raised concerns that breaching barricades could encourage others to violate prohibitory orders.“When you go and break a barricade, the chances of 10 or 20 more people in violation of 163 are very high,” the court said. The petitioners argued that the Sub-Divisional Executive Magistrate (SEM) lacked jurisdiction to extend their custody and had wrongly rejected their sureties. The court asked them to await the SEM’s decision and pursue the appropriate legal remedy if necessary, following which they withdrew their plea. The bench clarified that it had expressed no opinion on the merits of the case.
